Judge's ruling denies LASD effort to move BCS

The Santa Clara County Superior Court last week ruled against the Los Altos School District’s efforts to locate Bullis Charter School outside district boundaries.

School district trustees in May placed a bid on the Raynor Activity Center in Sunnyvale, with a mind to potentially housing the charter school on the site.

Following the bid, both the district and the charter school filed lawsuits.

The district’s suit asked for a legal interpretation of whether Proposition 39 – state law that requires school districts to provide “reasonably equivalent” facilities for charter schools – allows the district to offer Bullis Charter School a site outside district boundaries. If determined legal, the district requested that the court sanction its decision to purchase Raynor. Sunnyvale did not accept the district’s bid.

The charter school’s suit requested that the court compel the district to cease pursuing the Raynor site.

Judge Franklin Bondonno ruled Jan. 13 that the district “may offer a site outside of its boundaries to a charter school under Proposition 39 only if the charter school requests such a site and only if that request is in conformity to the school’s charter.”

“California law holds that BCS children have the same rights to local taxpayer facilities as other Los Altos area public school students,” said Ken Moore, chairman of the Bullis Charter School Board of Directors. “The court’s ruling reinforces this.”
