ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING  SECTIONS 10-1.202 OF THE MUNICIPAL CODE WITH REGARD TO THE DEFINITION OF "FAMILY"

 

      WHEREAS, the City Council of the Town of Los Altos Hills ("Town") wishes to amend the Municipal Code Title 10, Chapter 1, Article 2 with regard to the definition of "family".

 

      NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows:

      1.    AMENDMENT OF CODE.  Section 10-1.202 of Chapter 1 (Zoning) of  Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended to read as follows:

 

10-1.202 Designated

 

Family means one person or two or more individuals living together in a dwelling, sharing household responsibilities and activities, and having close social or economic or psychological commitments to each other.

 

      2.    SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder of this ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this ordinance are severable. The City Council of the Town of Los Altos Hills hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable.

     

      3.    EFFECTIVE DATE; PUBLICATION.  This ordinance shall become effective thirty (30) days from the date of its passage. Within 15 days after its passage, this ordinance shall be published once, with the names of those City Council Members voting for or against it, in the Los Altos Town Crier, a newspaper of general circulation in the Town of Los Altos Hills, as required by law.

ORDINANCE OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS AMENDING SECTION 10-1.702 (i) OF THE MUNICIPAL CODE

WITH REGARD TO ACCESSORY USES IN THE R-A ZONE

TRANSITIONAL AND SUPPORTIVE HOUSING

 

      WHEREAS, the City Council of the Town of Los Altos Hills ("Town") wishes to amend the Municipal Code Title 10, Chapter 1, Article 7 Accessory uses permitted (R-A) to include Transitional and Supportive Housing as Defined by the California Health and Safety Code.

 

      NOW, THEREFORE, the City Council of the Town of Los Altos Hills does ORDAIN as follows:

 

      1.    AMENDMENT OF CODE.  Section 10-1.702 of Chapter 1 (Zoning) of  Title 10 (Zoning and Site Development) of the Los Altos Hills Municipal Code is hereby amended to read as follows:

 

10-1.202 Accessory uses and structures permitted (R-A).

 

(a)   Home Occupations. Home occupations shall be permitted where the use is entirely subordinate to the primary use of the premises for the home of a family. There shall be no retail sales on the premises, no advertising of any kind visible from off the premises, no evidence from off the premises of the business, no parking more than normally required for a residence, and not over one assistant outside the family unit shall be employed. The raising on the premises of agricultural products and the sales thereof shall be expressly excepted from the provisions of this chapter but shall be subject to reasonable regulations by the Town.

(b)   Walls, Fences, Trees and Shrubs. Walls, fences, trees and shrubs shall be permitted within the confines of a lot or contiguous lots subject to the height limitations set forth in Section 10-1.504 of Article 5 of this chapter.

(c)   House Number Signs. A sign not more than one and one-half (1.5) square feet in area bearing the house number and the name of the occupant, or a name designated, other than one of a commercial purpose, shall be permitted.

(d)   Accessory Buildings. Accessory buildings may be constructed only in accordance with the setback requirements of this chapter. An accessory building may be erected prior to the construction of the main building only if it is agreed that the main building shall be completed within three (3) years from the date of the issuance of the permit for the accessory building. A temporary accessory building shall be

removed within thirty (30) days after the completion of the main building or within eighteen (18) months after the issuance of a permit for the accessory building, whichever is the earlier date.

(e)   Private Stables. A maximum of two (2) hoofed animals per acre shall be permitted provided one additional hoofed animal may be kept on each additional one-half acre, or fraction thereof, and provided, further, the conditions are satisfactory to the County Department of Health or such other agency as may be in charge of health standards for the Town.

(f)         Swimming Pools, Tennis Courts, Greenhouses and Workshops. Swimming pools, tennis courts, greenhouses, workshops, and other accessory uses found by the Planning Commission to comply with the definition of accessory use, shall be permitted.

(g)   Small Family Day Care Homes. Small family day care homes which provide care, protection and supervision of six (6) or fewer children (including children under the age of ten (10) years who reside at the home) in the provider?s own home, for periods of less than twenty-four (24) hours per day, while the parents or guardians are away, pursuant to State regulations, shall be permitted. No business license fee or tax shall be imposed on a small family day care home.

(h)   Residential Care Facility. The use of a dwelling unit or portion thereof licensed by the State of California for twenty-four (24) hour nonmedical care of up to six (6) persons per parcel or lot, (not including the provider, provider family or staff) in need of personal service, supervision, protection, or assistance essential for sustaining the activities of daily living. No exemptions from other Town ordinances and policies apply to this permitted accessory use.

(i)         Transitional and Supportive Housing. Transitional and Supportive housing shall be permitted as defined by the California Health and Safety Code for up to six (6) persons per parcel or lot. No exemptions from other Town ordinances and policies apply to this permitted accessory use.

(j)         Household Pets and Domestic Animals. Household pets and domestic animals as permitted by Town regulations may be kept.

(k)   Ornamental Garden Structures. Ornamental garden structures, such as benches, statuary, raised planters and fountains, shall be permitted.

(l)         Antennas and Dish Antennas. Antennas and dish antennas are permitted subject to the requirements set forth in Article 5 of Chapter 1 and Article 3 of Chapter 2 of Title 10.

(m)   One secondary dwelling on each parcel or lot of land in one ownership which is of at least one acre in gross area, subject to the applicable provisions of this chapter and other laws. The gross area shall be measured prior to any required dedication of right-of-way or access easements, when required as part of a site development permit application submitted subsequent to January 1, 1999. Secondary dwellings shall meet the following standards:

(1)   A secondary dwelling shall be subordinate to and architecturally consistent with the primary dwelling;

(2)   The secondary dwelling shall not exceed one thousand (1,000) square feet of floor area;

(3)   If the secondary dwelling is within or attached to the primary dwelling, it shall be constructed so that the entire structure appears to be one dwelling;

(4)   If the secondary dwelling is separate from the primary dwelling, it shall not be sited in a visually prominent location, and shall respect the visual and acoustic privacy of primary dwellings on contiguous lots;

(5)   The lot on which a secondary dwelling is located must be connected to the public sanitary sewer system or have a private sewage disposal system that is deemed to be adequate for the addition of the second dwelling by the Santa Clara County Division of Health Services; and must have an adequate water supply;

(6)   The secondary dwelling shall not have a significant adverse impact on traffic flow and safety;

(7)   Any vehicular access to a secondary dwelling shall be by a common driveway with the primary dwelling;

(8)   The views of prominent scenic features by primary dwellings on contiguous lots shall be preserved.

(n)   Temporary Trailer Coaches. Trailer coaches during construction or substantial remodeling of a primary dwelling are permitted, subject to receipt of a zoning permit, pursuant to Section 10-1.310, after a public hearing held by the Zoning Administrator pursuant to Section 10-1.1005. One trailer coach specifically designed and equipped for human habitation may be placed on a lot, in accordance with the setback requirements of this Code and occupied only by the owner of the lot and members of the owner's family, as a temporary residence during construction or substantial remodeling of the primary dwelling on the lot. This permit shall be granted for no more than six (6) months, but shall be renewable upon the determination of the Zoning Administrator that the use has not resulted in detriment or nuisance to the adjacent properties or the neighborhood. However, in all cases, the trailer coach shall be removed prior to building permit final.

(o)   Photovoltaic power generation facilities.

(p)   Solar thermal energy facilities.

PUBLIC NOTICE

OF INTENT TO ADOPT A

MITIGATED NEGATIVE DECLARATION

 

Project Location: Altamont Tank site, Neary Tank site, portions of Altamont Road, Byrne Park Road, Moody Road, Taaffe Raod, and Dezahara Way in Los Altos Hills, California

Project Description: The Purissima Hills Water District (District) is proposing to install various sized water mains within existing Town streets and water tank improvements at an existing tank site in the Town of Los Altos Hills. The project consists of the installation of approximately 7,200 feet of new water mains along Altamont Road, Byrne Park Lane, Moody Road, Taaffe Road and Dezahara Way, and seismic foundation upgrades and roof tank painting to the District?s Neary Tank No.2. Construction is expected to begin in October 2013 and continue until June 2014.

The District is the Lead Agency for the Neary Tank Utilization project. The District has prepared an Initial Study/ Mitigated Negative Declaration (IS/MND) finding that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because mitigating measures will be incorporated into the project.

If the District?s Board of Directors determines, based on a review of comments received on the proposed Mitigated Negative Declaration, that there is no substantial evidence that the project would result in a significant environmental impact and no formal protest of the proposed Mitigated Negative Declaration is filed, the Mitigated Negative Declaration will be adopted on August 14, 2013. It should be noted that adoption of a Mitigated Negative Declaration does not constitute approval of the project under consideration. The decision to approve or deny the project will be made separately as required by the District.

Title: 2013 PAVEMENT REHABILITATION PROJECT

     

Project Description:  The work consists, in general of 6-inch deep lift AC patching, 2-inch AC overlay, Microsurfacing, pavement markings replacement, and all associated work.

 

The work is to be completed within THIRTY (30) working days.

At the time this contract is awarded, the Contractor shall possess a Class A license.

 

A bid submitted by any Contractor who is not licensed to engage in business or act in the capacity of a contractor shall be considered non-responsive and shall be rejected, except for those exceptions governed by Section 7028.15 of the Business and Professions Code.

 

The Town of Los Altos Hills hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religion, national origin, ancestry, place of birth, sex, sexual orientation, age, or disability in consideration for an award.

 

Each bid must be accompanied by certified or cashier's check, or bidder's bond duly executed by a responsible corporate surety authorized to issue such bonds in the State of California, made payable to the Town of Los Altos Hills for an amount equal to at least ten (10) percent of the amount bid.

 

The successful bidder shall furnish a Labor and Materials Bond and a Faithful Performance Bond.

 

Pursuant to Section 1770 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of per diem wages applicable to the work to be performed, which rates are filed in the office of the City Engineer, and copies of which are available to any interested parties on request.

 

The Contractor may elect to receive 100 percent of payments due under the contract from time to time, without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Sections 22300 of the Public Contract Code.  All expenses of such substitute deposit shall be borne by the Contractor.  Securities eligible for investment under the section shall include those listed in Section 16430 of the California Government Code or certificates of deposit of a bank or savings and loan association.  The Contractor shall be the beneficial owner of any securities substituted for monies withheld and shall receive any interest thereon.  Such securities, if deposited by the Contractor, shall be valued by the City's Administrative Director, whose decision on valuation of the securities shall be final.

 

Alternatively, upon the Contractor's request, the City will make payment of retentions earned directly to the escrow agent. The Contractor may direct the investment of the payments into securities, and the Contractor shall receive the interest earned on the investments upon the same terms provided for securities deposited by the Contractor.  Upon satisfactory completion of the contract, the Contractor shall receive from the escrow agent all securities, interest and payments received by the escrow agent from the City, pursuant to the terms in Section 22300 of the public Contract code.

2013 Sanitary Sewer Repair and Rehabilitation Project

 

1. BID OPENING.   Bids will be received at the office of the City Clerk of the Town of Los Altos Hills, California, until 2:00 p.m. on Thursday, July 29, 2013, at which time they will be opened and read aloud.  Bids shall be submitted in sealed envelopes marked on the outside "Bid For 2013 Sanitary Sewer Repair and Rehabilitation Project?

 

2. WORK DESCRIPTION.  The work to be done consists of performing the Base Bid work and any Add Alternates "A", "B" "C" or "D" awarded by the Town; Base Bid work includes mobilization and demobilization, potholing all crossing utilities, cleaning/de-rooting and video inspection of the project site sewer mains, replacement of approximately 1,140? of existing 6" sewer pipe with 8" HDPE SDR 17 by Pipe Bursting Method, reshaping 8" existing manhole base, replacement of approximately 755? of existing piping 6" PVC via open trench spot repairs, reconnecting 4? sewer laterals and new piping cleaning, pressure testing and color video inspection; the total of Add Alternate work "A", "B", "C" and "D" would replace 374- of open trench piping installation with 374' of pipe bursting; add approximately 1,200? of pipe bursting, eight sewer lateral connections and ten manhole base reshapings; the restoration of all improvements disturbed by this operation at various locations throughout the Town of Los Altos Hills, replacing landscape in kind to the original condition, replacing the asphalt pavement, and replacing all damaged properties caused by this work; and doing all appurtenant work as shown on the plans and described in the specifications with the title 2013 Sanitary Sewer Repair and Rehabilitation Project and on file in the office of the Public Works Director.

 

3. PRE-BID METING.  A mandatory pre-bid meeting is scheduled for Monday, July 19, 2013 at 2:00 p.m. at the Town of Los Altos Hills Town Hall located at 26379 Fremont Road in the Town of Los Altos Hills.  This meeting is to inform bidders of project requirements and subcontractors of subcontracting and material supply opportunities.  Bidder's attendance is mandatory.

 

4. WORKING DAYS.  The work under this Contract is to be completed in THIRTY-FIVE (35) working days.

 

5. CONTRACTOR'S LICENSE.  A Class “A” Contractor's License is required for this work or a C-34, Pipeline license classifications which constitute a majority of the work.  No bid will be accepted from a Contractor who has not been licensed in accordance with Chapter 9, Division 3 of the Business and Professional Code.

 

6. BID DEPOSIT.  A Bid Deposit equals to at least ten percent (10%) of the total amount of the bid shall be placed in the sealed proposal.  The Bid Deposit shall be in one of the following forms:  cash, cashier's check or certified check payable to the Town, or bidder's bond in favor of the Town executed by an authorized surety company.

 

7. PERFORMANCE BONDS.  Performance guaranty bonds as set forth in Section 4-3 of the Special Provisions will be required from the successful bidder.

 

8. TOWN'S RIGHT TO REJECT BIDS.  The right is reserved, as the interest of the Town may require, to reject any or all bids, or to waive any informality or minor irregularity in the bids.

 

9. GENERAL PREVAILING WAGE RATES.  Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations.  These wages are set forth in the General Prevailing Wage Rates for this project, available from the California Department of Industrial Relations? Internet web site at http://www.dir.ca.gov.

 

10. OBTAINING THE PROJECT PLANS AND CONTRACT DOCUMENTS.   (a) A full set of plans and Contract Documents are available for inspection without charge at the office of the Public Works Department, Town of Los Altos Hills, 26379 Fremont Road, Los Altos Hills, CA 94022.

12. WITHDRAWAL OF PROPOSALS.  Any bid may be withdrawn at any time prior to the time fixed in the public notice for the opening of bids only by written request for the withdrawal of the bid filed with the Director of Public Works.  The request shall be executed by the bidder or his/her duly authorized representative.  The withdrawal of a bid does not prejudice the right of the bidder to file a new bid.  Whether or not bids are opened exactly at the time fixed in the public notice for opening bids, a bid will not be received after that time nor may any bid be withdrawn after the time fixed in the public notice for opening of bids.

 

13. RELIEF OF BIDDERS.  As stated in Public Contract Code Sections 5100 to 5108, inclusive (State Contract Act) concerning relief of bidders and in particular to the requirement therein, that if the bidder claims a mistake was made in his/her bid, the bidder shall give the Public Works Director written notice within five (5) days after the opening of the bids of the alleged mistake, specifying in the notice in detail how the mistake occurred.

 

14. DISQUALIFICATION OF BIDDERS.  More than one proposal from an individual, firm, partnership, corporation, or combination thereof under the same or different names will not be considered.  Reasonable grounds for believing that any individual, firm, partnership, corporation or combination thereof is interested in more than one proposal for the work contemplated may cause the rejection of all proposals in which such individual, firm, partnership, corporation or combination thereof is interested.  If there is reason for believing that collusion exists among the bidders, any or all proposals may be rejected.  Proposals in which the prices obviously are unbalanced may be rejected.

 

15. PREVIOUS DISQUALIFICATION, REMOVAL OR OTHER PREVENTION OF BIDDING. A bid may be rejected on the basis of a bidder, any officer of such bidder, or any employee of such bidder who has a proprietary interest in such bidder, having been disqualified, removed, or otherwise prevented from bidding on, or completing a federal, state, or local project because of a violation of law or a safety regulation.

 

16. RESPONSIBILITY FOR VERIFYING CONTRACT ADDENDA.  All bidders shall verify if any addenda for this project have been issued by the Town of Los Altos Hills. It is the bidder?s responsibility to ensure that all requirements of Contract addenda are included in the bidder's proposal.

 

17. ESCROW FOR SECURITY DEPOSIT IN LIEU OF RETENTION.  Pursuant to Public Contract Code Section 22300, for monies earned by the Contractor and withheld by the Town to ensure the performance of the Contract, the Contractor, may, at its option, choose to substitute securities meeting the requirements of said Public Contract Code Section 22300.
