Judge denies BCS motion to compel

Santa Clara County Superior Court Judge Patricia Lucas Monday denied Bullis Charter School’s motion to compel the Los Altos School District to provide reasonably equivalent facilities.

The charter school’s legal team urged the court to enforce the 2011 Court of Appeals ruling, which went against the district. The Court of Appeals ruling was based on the district’s 2009-2010 facilities offer to the charter school.

The motion to compel, which Lucas rejected Monday, addressed the charter school’s 2012-2013 facilities.

In her ruling, Lucas said she was not convinced that the charter school’s legal team was pursuing the proper court procedure.

While awaiting Lucas’ ruling, Bullis officials filed a new lawsuit over allocation of facilities for the 2012-2013 school year.
