In response to the Los Altos School District’s final offer of facilities for the 2009-2010 school year, Bullis Charter School representatives notified the district that the charter school would file legal action if its concerns were not met.
Under Proposition 39, the district must provide “reasonably equivalent space” for charter school students who reside within its boundaries.
The charter school’s attorney outlined several issues the charter school wants clarified, such as facilities for a proposed seventh- grade class, providing space comparable to other district campuses, and the shared agreement with Egan Junior High School, where the district has housed the charter school since its beginning.
Superintendent Tim Justus said the charter school notice is a part of the facility-use agreement process that the district engages in with the school every year.
In response to the allegation of not providing space for a seventh- grade classroom next year, Justus said school officials informed the district they would conduct a K-6 program on the campus next year.
“I believe we based the facility needs, rightly so, on what they will be having next year,” Justus said.
The notice from the charter school requested a response by June 9 (after the Town Crier’s press deadline). Justus said the district would respond with a letter explaining its legal justification of the final facilities’ offer.
Bullis Charter School Board President Ken Moore said that for five years the charter school has been unable to bridge the gap regarding the disagreements over the facilities.
“This is unfortunate but probably a necessary step,” Moore said. “I hope we can meet the needs of our students without any legal action.”
