Former Scout leader’s sentencing postponed

The sentencing of Los Altos resident Gregory Allen Wagner, 44, facing 27 years in prison on nine felony charges of molesting three Boy Scouts between 1987 and 1992, has been postponed to May 12.

After hearing a statement Friday from the brother of one of Wagner’s victims, Superior Court Judge Diane Northway imposed a condition on the former troop leader’s $300,000 bail: He cannot be within 100 yards of any school while awaiting sentencing.

Wagner pleaded no contest Dec. 28 to charges of committing a lewd act with a child under 14 by force, duress, menace and fear; continuous molestation of a child; and distributing harmful material (pornography) to a child. He led Los Altos Troop 31 for more than 20 years before his dismissal by the Pacific Skyline Council last year.

DA dismisses sewer notice allegations

The Santa Clara County Office of the District Attorney last week dismissed a complaint by self-styled council watchdog Gerry Madea that the Los Altos City Council violated Proposition 218 by failing to provide adequate notice of sewer fees.

Proposition 218 is meant to ensure that voters approve all taxes and most charges on property owners, including the calculation and use of sewer assessment revenues.

Deputy District Attorney Stephen P. Lowney said the issues were whether the city sewer charge is a property-related fee subject to Proposition 218 notice requirements and whether statutory mandates pre-empt the proposition.

Lowney said he will review Madea’s complaint after the state supreme court decides those issues in the case of Bighorn-Desert View Water Agency v. Beringson.

Delayed court date for ex-Explorers leader

The court appearance of Los Altos Hills resident Antonio “Tony” Graham, 29, who faces as many as eight years in prison, has been postponed to May 26. He could be sentenced at the hearing.

Graham pleaded no contest in January to 15 counts of illegal sexual activities involving girls in the Palo Alto Fire Explorers. The Pacific Skyline Council has dismissed him.

We’ve recently covered the passing of two of this community’s most involved and committed volunteers, Lee Lynch and Billy Russell. They represented an era when people helped out, not so they could get their name on a building, but because it was simply the right thing to do.

There’s a new generation of volunteers hard at work right now in this community who are carrying on their legacy. The level of involvement in the recent Los Altos Relay For Life event bears this out.
