A third male victim has been named in the case against Los Altos resident Gregory Wagner, a Boy Scout Troop 31 leader charged with child molestation.

Judge Diane Northway raised Wagner’s bail from $200,000 to $300,000 at a hearing last Friday. Wagner, 42, was arrested Aug. 25 at his home. He was a Boy Scout leader in the community for more than 20 years until the day of his arrest when he was dismissed from the Boy Scouts.

The accusations of the third victim brought the number of charges against Wagner from seven to nine felonies: seven counts of lewd or lascivious acts on a child under 14 and two counts on a 14- or 15-year-old child. If convicted, Wagner could face more than 27 years in jail.

James Blackman, his attorney, declined to disclose what Wagner would plead in the case.

“It takes additional time to properly investigate when the behavior is alleged to have occurred more than 15 years ago,” Blackman said.

A third restraining order was issued at the bail hearing. Two were issued earlier this month during Wagner’s arraignment.

Sam Liccardo, deputy district attorney, asked the judge to raise bail, citing concerns about risk of flight, risk to the community, the defendant’s “savvy” computer skills and the seriousness of the case.

The judge raised bail, but not

above the scheduled amount. “This case doesn’t merit other than scheduled bail,” Northway said. She called the bail adequate in light of the circumstances.

Wagner was a Boy Scout leader from the early 1980s until the end of August. The incidents allegedly occurred between 1988 and 1992, Liccardo said. “We do believe there were some incidents that happened before that,” he said, adding that those cannot be prosecuted because of the statute of limitations.

Most of the alleged illegal contact took place during scouting trips, according to the sheriff’s office.

Wagner chaperoned weekend trips in the Santa Cruz Mountains and weeklong summer camp trips in the Sierra and other parts of California.

Wagner faces charges that include a lewd act with a child under 14 by force, duress, menace and fear; continuous molestation of a child; and distributing harmful material (pornography) to a child, police said.

A hearing is scheduled for 2 p.m. Oct. 17 when the defense, prosecution and judge will discuss the case, Blackman said.
