Current Mountain View Mayor and Democratic candidate for the 22nd Assembly District Sally Lieber is the target of two lawsuits challenging her employment designation as it will appear on November ballot.
The lawsuits, petitioned by her rival in the upcoming election, Republican Stan Kawczynski, were scheduled for two different venues: the Santa Clara County Superior Court on a date not yet set and the Sacramento County Superior Court yesterday.
Kawczynski claims Lieber misled voters by illegally declaring “Councilwoman/Transit Director” as her employment status on the ballot for the Democrat primary earlier this year. When asked to rectify the statement in July for the final stage of the election, she ignored demands.
State law allows the listing of any profession and also permits the inclusion of elected offices. Appointed positions such as “mayor” cannot be used.
Kawczynski’s attorney Gary Wesley said Lieber falsely claimed to be a transit director, a position that never existed.
Kawczynski said Lieber incorrectly declared herself a “councilwoman.” Mountain View City Council removed any reference to sexes and replaced the term with “councilmember.”
“She is using the illegal designation to emphasize the fact that she is a woman as opposed to a man running for office,” he said. “She once told me she would never vote for a man, so I guess it may be her belief that there should only be ‘Councilwomen’ or ‘Assemblywomen’.”
Lieber refused to respond to specific questions put forward regarding Kawczynski’s and Wesley’s allegations but said she stands by her ballot description and is using the same description as in the Democratic primary election.
